Events Creations provides a platform for event organizers and vendors to manage events, inventory, customer communications, and related activities. Features may include text messaging services, inventory tracking, budget management, and other tools related to event organization and vendor participation.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your password and for all activity that occurs under your account.

4. Subscription and Billing

4.1 Free Trial

We offer a 7-day free trial of our Service. At the end of the trial period, you will be automatically charged for the subscription plan you selected unless you cancel before the trial ends.

4.2 Subscription Plans and Pricing

Current subscription plans include our Hobby plan starting at $11.99/month and our Pro plan starting at $19.99/month. While we try to keep things steady (because who likes surprises?), we reserve the right to change our prices at any time. Don't worry though—we're not planning on any dramatic price hikes, and if we do need to adjust pricing, we'll give you plenty of notice. It's just one of those things we legally need to mention.

4.3 Cancellation and Termination

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, your service will remain active until the end of your current billing period, after which your account will be downgraded or deactivated. We do not provide refunds for partial subscription periods or unused services. Think of it like buying a ticket to an event—even if you leave early, there's no partial refund.

4.4 No Refunds

All purchases are final. We do not provide refunds for any subscription fees, add-on services, or other charges. This strict no-refund policy helps us keep our prices reasonable for everyone. Please consider using our free trial to evaluate if our Service meets your needs before subscribing.

5. User Responsibilities

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. You are responsible for all content and activity that occurs under your account.

You agree not to:

Use the Service to transmit any material that is unlawful, threatening, abusive, libelous, or encourages conduct that would constitute a criminal offense
Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
Use any automated system, including "robots," "spiders," or "offline readers" to access the Service
Transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature
Violate or attempt to violate the security of the Service

6. Text Messaging Services

Our Service includes text messaging functionality that allows event organizers to communicate with vendors and attendees. By using this feature, you agree:

To obtain proper consent from recipients before sending them messages
To comply with all applicable laws and regulations regarding SMS communications, including the Telephone Consumer Protection Act (TCPA)
Not to use the Service to send spam, unsolicited messages, or content that violates any laws
That we are not responsible for the content of messages sent through our platform

We reserve the right to suspend or terminate your access to text messaging features if we believe you are using them inappropriately or in violation of these Terms.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are owned by Events Creations or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. User Content

You retain ownership of any content you submit, post, or display on or through the Service. By providing content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting the Service.

You represent and warrant that you own or have the necessary rights to the content you provide and that such content does not violate the rights of any third party.

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to our collection and use of personal information as described therein.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EVENTS CREATIONS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVENTS CREATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
ANY CONTENT OBTAINED FROM THE SERVICE
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE
ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE

We specifically want to clarify that we're not responsible for "dumb stuff" that could happen, including but not limited to: accidentally texting the wrong people, inventory counting errors that might lead to overselling, data loss due to forgetting to save your work, any lost business or revenue resulting from service outages, or any other mishaps that might occur while using our platform. We built this platform to be helpful, but we can't control how you use it or guarantee it will prevent all possible mistakes.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING YOUR CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Events Creations, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Washington for the resolution of any disputes.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our platform or by sending you an email or other notification. Your continued use of the Service after such modifications constitutes your agreement to the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, our Privacy Policy, and any additional terms to which you agree when using specific elements of the Service, constitute the entire agreement between you and Events Creations regarding the Service and supersede all prior agreements and understandings, whether written or oral.
